These Terms and Conditions ("Terms") govern your use of the mywediary.com platform (the "Service") operated by Wediary Technologies s.r.o., a company registered in the Czech Republic ("we", "us", "our"). By using the Service, you agree to these Terms.

1. Service Description

The Service provides a platform for creating personalized event upload pages, collecting guest photos and videos, managing media galleries, and sharing curated galleries. Features vary by plan type.

2. Provider Details

The Service is operated by Wediary Technologies s.r.o., IČO 249 42 031, with registered office at Korunní 2569/108, Vinohrady, 101 00 Praha 10, Czech Republic, registered in the Commercial Register maintained by the Municipal Court in Prague. Contact: support@mywediary.com.

3. Account Registration & Access

  • To use the Service as an event owner, you must purchase a plan and create an account.

  • You are responsible for maintaining the confidentiality of your account credentials.

  • Guest access to event upload pages does not require an account.

  • Guests using an event upload page are bound by these Terms with respect to their uploads, even though they do not create an account. Continued use of an upload page constitutes acceptance.

4. Plans & Payment

  • Plans are one-time purchases (not subscriptions) processed securely via Stripe.

  • Each plan includes a defined access window starting from your event date.

  • Plan upgrades and extensions are available as separate one-time purchases.

  • All prices are displayed in your local currency where available. Payments are final - refunds are handled on a case-by-case basis by contacting us at support@mywediary.com.

5. Right of Withdrawal

Because the Service consists of digital content not delivered on a physical medium, you acknowledge and expressly agree that the commencement of performance (i.e., access to the digital content being granted upon payment) terminates your statutory 14-day right of withdrawal without giving a reason under § 1837 letter l) of the Czech Civil Code. By placing an order and confirming your acceptance of these Terms, you grant your express consent that the Service be made available to you immediately upon payment, and you confirm that you have been duly informed of the loss of the right of withdrawal. Special rules apply to gift vouchers - see Section 6 below.

6. Gift Vouchers

  • Gift vouchers entitle the bearer to redeem a Wediary plan specified at the time of purchase. Vouchers are delivered as a PDF to the purchaser's email address.

  • The voucher is valid for 24 months from the date of purchase. After this period, the voucher expires and cannot be redeemed or refunded.

  • Each voucher contains a unique promo code that can be redeemed only once. Once redeemed, the associated plan is activated for the redeeming account and the voucher is consumed.

  • Vouchers are not exchangeable for cash and cannot be partially redeemed. The voucher itself is not transferable to another product, but the bearer of the code may redeem it on behalf of any recipient.

  • Right of withdrawal: Until the voucher is redeemed, the purchaser retains the standard 14-day statutory right of withdrawal under § 1829 of the Czech Civil Code. To exercise this right, contact us at support@mywediary.com within 14 days of purchase. Once the voucher has been redeemed, the digital content waiver in Section 5 applies and the right of withdrawal no longer exists.

  • No refunds are provided for vouchers that have been redeemed or have expired (unused after 24 months).

  • We are not responsible for lost, stolen, or forwarded voucher codes. Anyone in possession of the code may redeem it.

  • We reserve the right to invalidate vouchers obtained through fraud, abuse, or in violation of these Terms, without refund.

7. Event Pages & Media

  • You retain full ownership of all media (photos, videos) uploaded to the Service.

  • By uploading media, you grant us a limited license to store, process, and display the media solely for the purpose of providing the Service.

  • We do not sell, share, or use your media for any purpose other than delivering the Service.

  • Event owners are responsible for any content uploaded by their guests, and for ensuring that depicted persons have consented to their image being shared via the Service in accordance with applicable law.

  • File size limits apply: standard guest uploads are subject to the limits shown in the upload interface; professional (event-owner) uploads, where supported by your plan, currently allow up to 100 MB per photo and 5 GB per video.

  • A valid event date must be set in your account for the Service to function fully. Without it, features such as the full-capacity upload unlock, expiration dates, and lifecycle email notifications cannot operate correctly. The full upload capacity for guests typically unlocks shortly before the event date (around 7 days prior, depending on plan).

  • Where a plan describes uploads as "unlimited", this is subject to fair use. The Service is intended for personal event sharing; we reserve the right to throttle, restrict, or terminate accounts engaged in clearly excessive, automated, or commercial usage inconsistent with this purpose.

  • Guest uploads - license and warranty: By uploading media to an event page, the guest warrants that (i) they own or have permission to share the content, (ii) any clearly identifiable persons are aware of the upload, and (iii) the content does not violate the Acceptable Use rules in Section 9. Guests grant the event owner and Wediary a limited, non-exclusive licence to store, process, and display the uploaded media within the Service for the purpose of providing the gallery to the owner and permitted viewers.

  • Guest content removal: Guests may request removal of their own uploads at any time by contacting the event owner or support@mywediary.com. The event owner may also remove any guest upload at their discretion.

8. Data Retention & Deletion

  • After your plan's access window expires, your media and event data enter a 7-day grace period, after which they are permanently and irreversibly deleted from our systems and storage.

  • You may request account deletion at any time from your Account settings. Access is revoked immediately, and all associated data (events, media, profile) is permanently deleted 7 days after the deletion request. This action cannot be undone.

  • Once deleted, media cannot be recovered. We strongly recommend downloading your media (via ZIP download) before your plan expires or before you delete your account.

9. Acceptable Use

You (whether as an event owner or a guest) agree not to use the Service to:

  • Upload illegal, harmful, or offensive content, or content that infringes the rights of third parties (including image rights, copyright, or privacy).

  • Violate any applicable laws or third-party rights.

  • Attempt to gain unauthorized access to the Service or its infrastructure.

  • Use the Service for automated scraping, bulk uploads, or any non-intended purpose.

We reserve the right to:

  • Suspend, restrict, or terminate accounts that violate these Terms, and remove any infringing content, without prior notice.

  • Terminate or refuse the Service in cases of suspected fraud (including payment fraud or chargebacks), security threats, abuse, or where required by applicable law or regulation.

  • Discontinue providing the Service to any user at our discretion, in which case any unused, prepaid portion of the plan will be refunded on a pro-rata basis. Where termination is for cause (e.g. violation of these Terms, fraud, or abuse), no refund is due.

10. Shared Galleries

  • Event owners with eligible plans may publish a shared gallery accessible to guests.

  • The event owner controls which media appears in the Shared Gallery and whether it operates in live or curated mode.

  • Guests may download media from the Shared Gallery if permitted by the event owner's settings.

11. Service Availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability and are not liable for outages caused by technical issues, scheduled maintenance, third-party service failures, or events of force majeure. We may temporarily restrict or interrupt the Service for maintenance or updates and will, where reasonably possible, notify users in advance via the website or email.

12. Complaints Procedure

  • If the Service is not provided in accordance with these Terms or is not accessible to the agreed extent, you have the right to file a complaint.

  • Complaints must be submitted in writing to support@mywediary.com without undue delay after discovering the defect.

  • We will handle the complaint within 30 days of its receipt and inform you of the resolution.

13. Intellectual Property

  • The Service, including its design, code, branding, and features, is the property of Wediary Technologies s.r.o.

  • You may not copy, modify, distribute, or reverse-engineer any part of the Service.

14. Limitation of Liability

  • The Service is provided "as is" without warranties of any kind, express or implied.

  • We are not liable for any loss of data, including media, due to system failures, expired plans, account deletion, or events outside our control.

  • Our total liability is limited to the amount you paid for your plan.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code. Any disputes shall be resolved primarily by amicable means; failing that, by the competent courts of the Czech Republic, without prejudice to any mandatory consumer protection provisions of your country of residence under EU law.

Out-of-Court Dispute Resolution

Consumers have the right to out-of-court resolution of consumer disputes. The competent body for alternative dispute resolution (ADR) is the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, www.coi.cz, online form available at adr.coi.cz. EU consumers may also submit disputes via the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The parties undertake to replace any such provision with one that most closely reflects its original purpose.

17. Changes to These Terms

We may update these Terms from time to time. Changes take effect when published on this page with an updated date. Continued use of the Service after changes constitutes acceptance.
